Terms and conditions

These terms and conditions (the «Terms») govern access to and use of the riverz platform (the «Service»), available at riverz.co. By creating an account or using the Service, you accept these Terms and our Privacy policy. If you do not agree, you must not use the Service.

riverz is an omnichannel support and CRM platform that lets merchants and companies centralize, automate and respond, from a single inbox, to their customers' conversations on WhatsApp, Instagram, Messenger, Mercado Libre and email, as well as manage campaigns, products and AI-assisted replies. We may modify, expand or suspend features of the Service at any time.

To use the Service you must create an account with truthful information and keep it up to date. You are responsible for the confidentiality of your credentials and for all activity that occurs under your account. You must be of legal age and have the legal capacity to contract, and use the Service on behalf of a legitimate company or commercial activity.

By using the Service you agree not to:

• Send spam, unsolicited messages or content that infringes the policies of WhatsApp, Meta or other connected channels.
• Use the Service for illegal or fraudulent purposes or in ways that violate the rights of third parties.
• Attempt to gain unauthorized access to systems, data or accounts that do not belong to you.
• Overload, interfere with or compromise the security or operation of the Service.

You are solely responsible for the content you send and for obtaining the necessary consent from the recipients of your messages.

The Service integrates with third-party platforms (Meta/WhatsApp, Instagram, Messenger, Mercado Libre, Shopify, email providers and AI models). Use of those integrations is subject to the terms and policies of each provider. By connecting an account you represent that you are authorized to do so and you authorize us to access the data of that account necessary to provide the Service, solely for that purpose. We are not responsible for changes, interruptions or decisions by those platforms that affect the Service.

Some features of the Service may require a paid plan. Prices, billing cycles and applicable conditions are disclosed at the time of purchase. Unless the law requires otherwise, payments are non-refundable. We may update prices by giving reasonable advance notice.

The Service, its software, brand and content are the property of riverz or its licensors. We grant you a limited, non-exclusive and non-transferable license to use the Service in accordance with these Terms. You retain ownership of the data and content you upload or manage through the Service.

The processing of personal data is governed by our Privacy policy. When you connect your accounts, we process data on your behalf and under your instructions solely to provide the Service.

We work to keep the Service available and secure, but it is provided «as is» and «as available», without warranties of uninterrupted or error-free operation. To the extent permitted by law, we do not guarantee any specific commercial results arising from use of the Service.

To the maximum extent permitted by law, riverz shall not be liable for indirect or incidental damages or lost profits arising from the use of, or inability to use, the Service. Our total liability shall be limited to the amount paid for the Service in the twelve (12) months prior to the event giving rise to the claim.

You may stop using the Service and close your account at any time. We may suspend or cancel your access if you breach these Terms or if your use compromises the security or legal compliance of the Service. Following termination, we will delete or anonymize your data in accordance with the Privacy Policy.

We may update these Terms. We will publish the current version on this page along with its update date. Continued use of the Service after the changes implies acceptance of them.

These Terms are governed by the laws applicable in the jurisdiction where riverz operates. Any dispute shall be submitted to the competent courts of that jurisdiction, without prejudice to any rights that the law recognizes as non-waivable.

Riverz lets AI agents place and answer phone calls on your behalf (order confirmation, cart recovery, follow-ups, campaigns and inbound calls). As the business, you agree to: (a) only call people with a relationship or lawful basis for contact; (b) respect allowed calling hours, retry limits and "do not call" (opt-out) requests; (c) comply with the telemarketing, data-protection and call-recording laws of each country you operate in, including recording notice and/or consent where required. Riverz provides controls (hours, opt-out, recording disclosure, kill switch), but lawful use is your responsibility. Call minutes and voice models may be billed per your plan.
